WAIVER OF LIABILITY
By subscribing to a membership or participating in any activity held by INSTINCT MARTIAL inc., I hereby release and forever discharge the team at INSTINCT MARTIAL inc.—including instructors, administrators, guests, and students—from any and all liability, without exception or reservation, for any accident or damage of any kind related to the training and practice of Kung Fu, Tai Chi, TRX, Jiu Jitsu, Self-Defense, or any other activities/events organized by INSTINCT MARTIAL inc. I acknowledge that I am fully aware of the risks associated with practicing Kung Fu, martial arts, and, more generally, high-intensity physical activities. I agree to become informed of and follow all safety rules and instructions provided by the organizers and venue owners as they apply to my participation in Kung Fu classes. Accordingly, I waive any legal recourse against INSTINCT MARTIAL inc., its instructors, administrators, guests, and students in the event of an accident or damage of any nature.
I certify that I am covered by liability insurance for any harm or injury I may cause to others or to property during the practice of Kung Fu or, more broadly, combat sports. I also acknowledge that INSTINCT MARTIAL inc. assumes no responsibility or obligation to provide me with financial or other assistance, including but not limited to medical, health, disability services, or insurance of any kind in the event of injury, illness, death, or damages. I waive all claims for compensation or liability against INSTINCT MARTIAL inc. for any injury or medical expenses I may incur.
I release and forever discharge INSTINCT MARTIAL inc. from any claims arising from first aid treatment or other medical services rendered in the event of an emergency during my participation in Kung Fu, martial arts, or any intense physical activity.
I understand that learning Kung Fu may involve activities that could be dangerous, including but not limited to martial arts training that inherently involves risk. As a student, I expressly assume the risk of injury or damage resulting from these activities and release INSTINCT MARTIAL inc. from all liability for bodily harm, illness, or death resulting from martial arts practice or while engaged in Kung Fu activities.
I acknowledge that it is solely my responsibility to safeguard my belongings and the belongings of others. I will not hold INSTINCT MARTIAL inc., its instructors, administrators, guests, or students liable in the event of loss, theft, or damage to my property. I commit to showing respect for the property of others and the equipment in the training space, and to returning any item that does not belong to me at the end of the class.
As a student, I agree that this waiver is intended to be as broad and inclusive as permitted by the laws of Québec and Canada, and that it shall be governed by and interpreted in accordance with those laws. If any provision or clause of this document is found to be invalid, the enforceability of the remaining provisions shall not be affected.
As an active member of INSTINCT MARTIAL inc., I hereby confirm that I understand and voluntarily agree to enter into this waiver and release of liability.
